1. Acceptance of These Terms
By downloading, accessing, or using LumaVPN, you agree to these Terms of Use and the Privacy Policy. If you do not agree, do not use the App or services.
In these Terms, “LumaVPN,” “we,” “us,” and “our” refer to the provider of the LumaVPN service. “You” refers to the person using the service.
2. Eligibility
You must be at least 13 years old, or the minimum age required by your local law to use an online service without parental consent. If you are not legally able to enter into these Terms, a parent or legal guardian must review and accept them for you.
3. The Service
LumaVPN provides tools that may include VPN connections, free and premium nodes, IP and network information, connection-status reporting, latency information, tunnel controls, locally tracked VPN duration, invitations, daily check-ins, and subscription features.
VPN performance depends on your device, network, location, selected node, third-party infrastructure, and other conditions outside our control. LumaVPN does not guarantee that a particular website, app, service, location, or node will always be available or reachable.
4. Limited License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use LumaVPN on Apple devices that you own or control, as permitted by Apple’s usage rules, solely for lawful personal use.
LumaVPN, its design, code, branding, graphics, and service content are owned by us or our licensors and are protected by applicable intellectual-property laws. No rights are granted except those expressly stated in these Terms.
5. Acceptable Use
You must use LumaVPN in compliance with all applicable laws and third-party rights. You may not:
- Use the service for unlawful, fraudulent, abusive, harassing, or harmful activity.
- Distribute malware, attack systems, send spam, interfere with networks, or bypass access controls without authorization.
- Infringe intellectual-property, privacy, confidentiality, or other rights.
- Resell, rent, sublicense, or commercially exploit the service without written permission.
- Reverse engineer, modify, defeat technical protections, or attempt to derive source code except where applicable law expressly permits it.
- Use automated methods or excessive traffic in a way that degrades the service or affects other users.
- Misrepresent your identity, entitlement, subscription status, invitations, rewards, or connection results.
6. App Sessions and Device Identifiers
LumaVPN may create an app session using a generated device identifier and related authentication information. You are responsible for maintaining control of your device and for activity performed through your installation. Do not attempt to copy, sell, manipulate, or misuse session credentials.
7. Subscriptions and Billing
Where offered, premium features may require an automatically renewing subscription purchased through Apple’s App Store. The price, billing period, free trial if any, and included features are shown before purchase.
- Payment is charged to your Apple Account when the purchase is confirmed.
- A subscription renews automatically unless you cancel it through your Apple Account at least 24 hours before the end of the current billing period, subject to Apple’s then-current rules.
- Apple manages billing, cancellation, and eligible refunds. We do not control Apple’s payment processing.
- You can manage subscriptions in iOS Settings under your Apple Account and Subscriptions.
- You may use Restore in the App to request restoration of eligible purchases made with the same Apple Account.
Subscription features, prices, and plans may change. Changes apply as permitted by Apple’s rules and applicable law.
8. Free Time, Check-Ins, and Invitation Rewards
LumaVPN may provide promotional VPN duration through initial grants, daily check-ins, invitations, or other activities. Promotional time:
- has no cash value and cannot be transferred, sold, withdrawn, or exchanged;
- may be subject to eligibility, device, account, invitation, or technical validation;
- may be corrected, withheld, or removed when obtained through error, duplication, manipulation, or abuse; and
- may be modified or discontinued for future activity.
9. Third-Party Services
The service depends on third parties, including Apple, internet providers, VPN infrastructure, backend infrastructure, IP-information providers, and websites or apps you choose to access. We do not control and are not responsible for third-party content, availability, security, policies, or conduct.
10. Availability, Updates, and Changes
We may update, suspend, limit, replace, or discontinue any part of LumaVPN, including nodes, protocols, limits, rewards, and premium features. Updates may be required for continued use. Maintenance, network conditions, legal restrictions, security events, or third-party failures may interrupt service.
11. Privacy
Our Privacy Policy explains the information processed in connection with LumaVPN. By using the service, you acknowledge those practices.
12. Disclaimers
To the maximum extent permitted by law, LumaVPN is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, and error-free operation.
We do not guarantee anonymity, access to particular content, prevention of all tracking or threats, or that VPN routing will be lawful or suitable in every location. You remain responsible for your activities, accounts, security practices, and compliance with law.
13. Limitation of Liability
To the maximum extent permitted by law, we and our licensors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or business; service interruption; unauthorized access; or third-party conduct arising from or related to LumaVPN.
Where liability cannot be excluded, our total liability for claims relating to the service will not exceed the greater of the amount you paid for LumaVPN during the twelve months before the claim or USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Suspension and Termination
You may stop using LumaVPN at any time. We may suspend or terminate access when reasonably necessary to address violations, abuse, security risks, legal requirements, nonpayment, or discontinuation of the service. Sections that by their nature should survive termination will remain effective.
15. Apple-Specific Terms
These Terms are between you and us, not Apple. Apple is not responsible for LumaVPN or its content, maintenance, support, warranties, or claims relating to the App, except as required by law or Apple’s applicable rules.
If LumaVPN fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by Apple’s policies. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism, and you are not listed on a U.S. Government prohibited or restricted-party list.
16. General Terms
These Terms and the Privacy Policy are the agreement between you and us concerning LumaVPN, subject to any mandatory Apple terms. If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, transfer, or sale.
Applicable law governs these Terms without overriding consumer protections that cannot be waived. Disputes will be handled by courts with lawful jurisdiction unless applicable law requires another process.
We may update these Terms by posting a revised version with a new effective date. Continued use after the revised Terms become effective constitutes acceptance to the extent permitted by law.
